Scammed by an outfitter

Thanks for your input guys. I think reaching out to DOPL and looking into small claims court are both good ideas. The small claims court process looks complicated, but I may just be motivated enough to figure it out. Its an expensive and unfortunate lesson to learn, but I agree, a verbal agreement is worthless these days.

For those curious who this is I'm going to give him till Tuesday to respond and if he doesn't I'll update the thread with the company name.

Give him a deadline. YOu can report the transaction as fraud to the bank and likely get it back.

You have 3 days to respond or we'll go to court, report you to the state, bomb your FB account(s), which I'll win, and you'll be on the hook for legal fees. Just pay back my money and we'll go on our way. And I'll tell your bishop.
 
LOL... I had a bishop go to prison for cocaine trafficking and running a prostitution ring. The guy was in his mid 60s at the time.

Looks like the fishing trips on KSL are being booked through Fins & Fur Guide Service: http://www.finsandfurguiding.com/home.html

The phone number for Fins & Fur matches the number for the other hunts offered on KSL from this dude.
Ok, so for fraud folks, would that indicate it's an offshore fraudster or a local scam artist. Offshore is a lot harder to pursue obviously.
 
Wow this blew up. I'd ask for his liability insurance indemnity- anyone who does any official service or consulting/contracting has insurance. Being a registered LLC and licensed outfitter is different, if I remember correctly.

The contract part where it says refund over 12 months and approved is absolutely bogus. I'd never sign that in a million years. Looks like it was a contract made on google.

There should be, at a minimum, a failure to perform clause.

Did OP have a contract signed?

Quick update on all of this. I spoke with Zack and he is willing to work with us. He apologized and said that he brother had been running the business for the last couple of months while he was dealing with some medical issues. I didn't press him much on this and just tried to stay solution oriented. He offered a few potential solutions one of which was a public land guided OTC elk hunt including an airbnb.

Our schedules being busy this year we settled on two cow depredation tags on another property he has a lease for, and one month of access to try and fill those tags. He says that he has a few leases to choose from and that they are between 2,000 - 5,000 acres. Eight other hunters (10 total) will have access to the lease. I would have preferred a refund, but something is better than nothing.

I'm cautiously optimistic that things will work out, but not getting my hopes too high.
I'd ask for written permission from the landowner if it were me. Why not get a refund? You have him over a barrel. Get the money and walk away. Fool me once, shame on you. Fool me twice shame on me.

I'd much prefer a refund than the headache of all of this just to get a refund in the end."

You can be nice and still get a refund. I'd further bet that a few folks on this site wouldn't mind pointing you in the right direction to fill a couple of cow tags. I wouldn't touch a guided public land hunt with a 55 1/2' pole.
